Last updated: February 12, 2026
This Privacy Policy explains how Kwajelyn Outdoor Living ("Kwajelyn", "we", "us") collects, uses, shares and protects personal information when you visit kwajelyn.com or contact us about outdoor living work. The site and the business are owned and operated by David Smith, 2957 Poco Mas Drive, Frisco, TX 75034.
1. Information we collect
Information you give us. When you submit the estimate form, call, or email us, we may collect your name, phone number, email address, project address or city, project type, budget range and any details you choose to share about your property.
Information collected automatically. Our hosting provider records standard server logs, including IP address, browser type and version, operating system, referring page, pages requested and timestamps. If you consent to analytics cookies, we also collect aggregated page-view and interaction data.
Information we do not collect. We do not knowingly collect Social Security numbers, financial account numbers, biometric data, precise geolocation, or information from children under 13 through this website.
2. How we use information
- To respond to your estimate request and schedule a consultation
- To prepare drawings, proposals, permit applications and HOA submissions
- To perform the contract if you hire us, including scheduling and warranty service
- To maintain security, prevent fraud and diagnose technical problems
- To measure which pages are useful, if you have consented to analytics
- To meet legal, tax, insurance and record-keeping obligations
3. Legal bases and marketing
We process your information to take steps at your request before entering a contract, to perform a contract, to comply with legal obligations, and for our legitimate interest in operating and improving the site. We do not sell personal information, and we do not share it with third parties for their own direct marketing. We send no marketing email or SMS unless you separately opt in, and every message includes a way to stop.
4. Advertising and measurement
We may advertise on search and display networks, including Microsoft Advertising and other ad platforms. Where such tags are used, they may set cookies or similar identifiers to measure whether a visit resulted in a call or a form submission. These tags are treated as optional cookies and are loaded only after you accept optional cookies in our banner. You can review platform-level controls in the Cookie Policy.
5. Sharing
We disclose personal information only to: our web host and email provider; licensed electrical, plumbing, masonry and engineering partners who need address and scope details to perform work on your project; city permitting departments and your HOA where an application requires it; our insurer or legal counsel in the event of a claim; and authorities where required by law. Each partner receives only what is necessary for their task.
6. Retention
Estimate inquiries that do not become projects are retained for 24 months, then deleted. Project records, contracts and warranty documentation are retained for seven years after completion, consistent with Texas statute of limitations and tax record requirements. Server logs are retained for up to 12 months.
7. Security
The site is served over HTTPS. Access to inquiry data is restricted to the owner and the project coordinator, protected by unique accounts and multi-factor authentication where the platform supports it. No method of transmission or storage is perfectly secure, so please do not send sensitive financial details through the website form.
8. Your rights
Texas residents have rights under the Texas Data Privacy and Security Act, including the right to confirm whether we process your personal data, to access it, to correct inaccuracies, to request deletion, to obtain a portable copy, and to opt out of targeted advertising or sale of personal data. Residents of other states, and visitors from the EEA or UK, may have comparable rights. We honor verified requests regardless of where you live.
To exercise a right, email webmaster@kwajelyn.com with the subject line "Privacy Request" or call 214-518-4143. We respond within 45 days and may ask for information to verify your identity. You will never be charged or receive a lesser service for exercising a right. If we deny a request, you may appeal by replying to our decision; if the appeal is denied you may contact the Texas Attorney General.
9. Do Not Track and global signals
Our cookie banner is the primary control. We also honor recognized opt-out preference signals, including Global Privacy Control, by treating them as a rejection of optional cookies.
10. Third-party links
Pages may link to external sites such as manufacturer specifications or a map provider. We do not control those sites and are not responsible for their privacy practices.
11. Changes
If we materially change this policy we will update the date at the top of this page and, where appropriate, note the change on the homepage for 30 days.
